DATA COLLECTION AND PROCESSING

“Peppo and Pets”, as Data Controller, is obliged to inform users of its website about the collection of personal data that may be carried out, either by sending an email or by completing the forms included on the website. Only the data required to perform the contracted service or to adequately respond to the request for information made by the User will be obtained.

Contact/email forms

Purpose: Respond to your request for information made through our contact form(s).

Legitimation: The legal basis that legitimizes this treatment is the consent of the User, which may be revoked at any time.

Data transfer: Personal data will be processed through our servers, which will be considered the Data Processor. In addition, our email service provider, through which communications will be made, is Google, LLC, through Google Suite.

Mailing list subscription forms (newsletter)

Purpose: Sending commercial communications of interest to the User. As established by the LSSICE, “Peppo and Pets” undertakes not to send commercial communications without identifying them as such. For these purposes, information sent to customers for the maintenance of the existing contractual relationship will not be considered as commercial communication.

Legitimation: The legal basis that legitimizes this treatment is the consent of the User, which may be revoked at any time.

Data transfer: Personal data will be processed through servers managed by Active Campaign, which will be considered the Data Processor.

Customer registration/sign-up forms

Purposes:

• Manage your User registration on our website.
• Manage purchases made on our website.
• Provide information about the processing and status of purchases.
• Historical record of purchases made on our website.
• Sending communications via email and/or telephone, in order to inform the User of possible incidents, errors, problems and/or status of orders.

Legitimation: The legal basis that legitimizes this treatment is the execution of a contract.

Data transfer: “Peppo and Pets” will not transfer or communicate your data to any third party, except in cases provided for by law or when the provision of a service implies the need for a contractual relationship with a Data Processor. Thus, the User accepts that some of the personal data collected may be provided to these Data Processors (payment platforms, agencies, intermediaries, etc.), when necessary for the effective performance of the contracted service. The User also accepts that some of the services may be, totally or partially, subcontracted to other persons or companies, who will be considered Data Processors, with whom the corresponding confidentiality agreement has been agreed, or adhered to their privacy policies, established on their respective websites. The user may refuse to transfer his/her data to the Data Processors, by means of a written request, using any of the means previously mentioned.

In addition, in those cases where it is necessary, Client data may be transferred to certain bodies, in compliance with a legal obligation: Spanish Tax Agency, banking entities, Labor Inspection, etc.

SECURITY MEASURES

Users are hereby informed that “Peppo and Pets” has adopted the technical and organisational measures in accordance with the provisions of data protection regulations. The personal data collected in the forms are processed solely by the staff of “Peppo and Pets” or by the Data Processors established herein.

Appropriate security measures have been adopted for the data provided and, in addition, all technical means and measures within its reach have been installed to prevent the loss, misuse, alteration, unauthorized access and theft of the data provided to us.

The “Peppo and Pets” website also has SSL encryption, which allows the User to securely send their personal data through the website’s contact forms.

VERACITY OF THE DATA

The User declares that all the data provided by him/her are true and correct and undertakes to keep them updated. The user will be responsible for the veracity of his/her data and will be the sole party responsible for any conflicts or disputes that may arise from the falsity of said data. It is important that, so that we can keep personal data updated, the user informs “Peppo and Pets” whenever there has been any change in said data.

EXERCISE OF RIGHTS

The LOPD and the RGPD grant interested parties the possibility of exercising a series of rights related to the processing of their personal data. To do so, the user must provide documentation proving their identity (ID or passport) by email to guau@peppoandpets.com, or by written communication to the address that appears in our Legal Notice. Said communication must include the following information: name and surname of the User, the request, address and supporting data.

The exercise of rights must be carried out by the User him/herself. However, they may be carried out by a person authorized as the User's legal representative, providing documentation proving such representation.

The user may request the exercise of the following rights:

• Right to request the access to personal data.
• Right to request your rectification(in case they are incorrect) or suppression.
• Right to request the limitation of their treatment, in which case they will only be kept by “Peppo and Pets” for the exercise or defense of claims.
• Right to object to the processing: “Peppo and Pets” will stop processing your data, unless for legitimate reasons or the exercise or defense of possible claims they must continue to be processed.
• Right to the portability Data: If you want your data to be processed by another company, “Peppo and Pets” will facilitate the portability of your data in an exportable format.

In the event that consent has been granted for a specific purpose, The user has the right to withdraw consent at any time, without affecting the legality of the processing based on consent prior to its withdrawal.

If a user considers that there is a problem with the way in which “Peppo and Pets” is handling their data, they can direct their complaints to the Security Officer or to the corresponding data protection authority, the Spanish Data Protection Agency being the appropriate authority in the case of Spain.

DATA CONSERVATION

The personal data of Users who use the contact form or subscribe to the newsletter will be processed for the time strictly necessary to respond to the request for information, or until the consent granted is revoked.

The Client's personal data will be processed until the contractual relationship ends. The period of conservation of personal data will be the minimum necessary, and may be kept until:

• 4 years: Law on Violations and Sanctions in the Social Order (obligations regarding membership, registration, deregistration, contributions, payment of salaries, etc.); Arts. 66 et seq. General Tax Law (accounting books, etc.)
• 5 years: Art. 1964 Civil Code (personal actions without special term)
• 6 years: Art. 30 Commercial Code (accounting books, invoices...)
• 10 years: Art. 25 Law on Prevention of Money Laundering and Financing of Terrorism.
• No deadline: disaggregated and anonymized data.

In the event that candidate data (CV) is processed, “Peppo and Pets” may store your CV for a maximum of two years to include it in future calls for applications, unless the candidate states otherwise.

INTERNATIONAL DATA TRANSFERS

“Peppo and Pets” uses the mailing services of https://www.activecampaign.com/. The user expressly and unequivocally accepts his/her consent to the processing of his/her data and to the international transfer thereof to this/these service provider/s.

CONFIDENTIALITY

The information provided by the client will, in any case, be considered confidential and may not be used for purposes other than those described herein. “Peppo and Pets” undertakes not to disclose or reveal information about the User's claims, the reasons for the advice requested or the duration of its relationship with the User.

VALIDITY

This privacy and data protection policy was drafted on February 14, 2019, and may vary depending on changes in regulations and jurisprudence that may occur. It is the responsibility of the data owner to read the updated document in order to know their rights and obligations in this regard at all times.
